Acceptable Use Policy

1. Introduction

This Acceptable Use Policy (“AUP”) governs your access to and use of Truepic Inc.’s digital provenance and authenticity platform (the “Service”) and mobile applications (the “App”). The Service and App are sometimes collectively referred to herein as the “Services.” If you are accessing or using the Services on behalf of a company that is a Truepic customer, you represent that you are authorized to accept this AUP on behalf of that company, and that this AUP applies to both you and the company.

By accessing or using our Services, you agree to comply with our Terms of Service and all of our policies, including this AUP, as well as all applicable laws and regulations. If you do not agree, you must not access or use the Services. Violation of this AUP may result in suspension or termination of your access to our Services.

We may modify this AUP at any time, with such modifications becoming effective upon posting to the Services, Truepic’s website, or any app store. Your continued use of the Services following any modification constitutes your acceptance of the AUP, as modified.

2. Permitted Use

Our Services are designed to establish the digital provenance and authenticity of photos and videos for legitimate business purposes. The purpose of this AUP is to ensure the Services are used in a manner that maintains the integrity, security, and reliability of our Services. You may use our Services solely for lawful purposes and in accordance with this AUP. You agree to use the Services only for the purpose of establishing the digital provenance and authenticity of photos and videos as intended by the Services’ design and functionality.

3. Prohibited Activities

When using our Services, you agree not to upload, transmit, or distribute, or permit the uploading, transmitting, or distribution of Objectionable Content (as defined in our Terms of Service), which includes content that:

  • contains any material that by itself, or by its use in connection with the Services, infringes, misappropriates or violates the rights of any person or entity;
  • contains material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights (including, without limitation, trademark, privacy and publicity rights) unless you are the owner or licensor of such rights;
  • contains or installs any viruses, worms, malware, Trojan horses, or other harmful or destructive code;
  • contains unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” or any other form of solicitation;
  • is unlawful, libelous, defamatory, offensive, threatening, hateful, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable or inappropriate;
  • contains child exploitation material, non-consensual intimate images, or deepfakes created without consent;
  • contains personally identifiable information, except with the consent of the individual to whom such information relates or as otherwise expressly permitted under applicable data protection and privacy laws; or
  • may damage, interfere with, or disrupt the Services or any third-party systems.

You also agree that you will not:

  • interfere with, overload, or disrupt the Services or servers or networks connected to the Services, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature;
  • gain or attempt to gain unauthorized access to our Services, systems, networks, or user accounts, or create or attempt to create unauthorized accounts;
  • use the App on devices that have been jailbroken, rooted, or modified to remove manufacturer restrictions;
  • use the App with developer mode, USB debugging, or similar development features enabled;
  • circumvent any security features or access controls;
  • use automated tools (bots, scrapers, crawlers, scripts, spiders, etc.) in connection with the Services without Truepic’s express prior written authorization;
  • reverse engineer, decompile, disassemble, or attempt to derive source code from our Services without Truepic’s express prior written authorization;
  • conduct security testing or vulnerability assessments without Truepic’s express prior written authorization;
  • “deeplink” to the Services without Truepic’s express prior written authorization;
  • frame or utilize framing techniques to enclose any part of the Services without Truepic’s express prior written authorization;
  • share account credentials or allow unauthorized access to your account;
  • impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity;
  • create fake, misleading, or fraudulent authentication reports;
  • manipulate metadata or attempt to falsify authentication results;
  • engage in activity that places unreasonable load on our infrastructure;
  • violate any applicable local, state, national, or international law or regulation;
  • violate the terms of any app store from which you downloaded the App, or download the App from unofficial sources;
  • violate the terms and conditions of any platform that offers Truepic Services to its customers;
  • engage in any unlawful or tortious activity or facilitate illegal or tortious activity;
  • otherwise use the Services not as they are intended to be used; or
  • allow your customers to violate this AUP, encourage, aid, or abet others in violating this AUP, or take any action in attempt to do any of the foregoing prohibited actions.

4. Content Responsibilities

You are responsible for any photos, videos, or other content you upload to our Services, and by uploading the aforementioned content, you expressly consent for Truepic to store and process this content in accordance with the delivery of Services. You further represent and warrant to us that:

  • you own or have necessary rights to all content you upload;
  • your content does not violate any third-party rights; 
  • your content is not fraudulent; and
  • your content complies with all applicable laws and this AUP.

We reserve the right, but have no obligation, to monitor all content for compliance with this Policy.

5. Device Integrity Requirements

You agree not to use our Services on devices that have been: 

  • jailbroken (iOS) or rooted (Android), or otherwise have removed limitations imposed by the device manufacturer or carrier;
  • modified to run in developer mode for purposes of circumventing security features or authentication mechanisms;
  • altered in any way that compromises the integrity of the operating system’s security features; or
  • configured to bypass digital rights management or other technical protection measures.

Use of such modified devices with our Services may compromise the security and integrity of our authentication processes and is strictly prohibited. 

6. Account Security

You must:

  • maintain the confidentiality of your login credentials;
  • use strong, unique passwords for your account;
  • immediately notify us of any unauthorized access or security breach; and
  • enable multi-factor authentication when available.

7. Enforcement

We reserve the right, but do not assume the obligation, to investigate any violation of this AUP. We may, in our sole discretion:

  • remove, disable access to, modify or refuse to authenticate any content that violates this AUP;
  • suspend or terminate your access to the Services and your account without prior notice;
  • report violations to law enforcement or relevant authorities as we deem appropriate;
  • disclose information to satisfy any law, regulation, legal process, or governmental request; 
  • pursue legal remedies, including damages; and 
  • take any other action we deem appropriate.

8. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately to security@truepic.com. Please provide as much detail as possible to assist us in addressing the violation promptly.
